Mediation Rates
Mediation Rate Options and Information
- In Orange County, services may be retained either on an hourly or “daily” rate basis. Mediation services are offered exclusively on a “daily” rate basis outside of Orange County.
- The “daily” mediation rate is $4,800, and entitles the parties to the time Mr. Ashley spends preparing for the mediation and up to 12 hours of his time on the day of the mediation. Mr. Ashley blocks out the entire day for a mediation booked on this basis. Where travel outside of Southern California is required, counsel are charged an additional $1,000 to cover Mr. Ashley’s travel, lodging and meal expenses.
- Mr. Ashley’s hourly rate is $485 per hour. When Mr. Ashley is retained on this basis, he requires counsel to advance payment for 1 hour of “prep” time and for the number of hours reserved for the mediation. In addition, the attorneys are invoiced at the applicable hourly rate for all hours worked beyond the number of hours reserved for the mediation. The “daily” mediation rate cap does not apply if the hourly rate option is selected. As such, it is frequently more economical to retain Mr. Ashley on a “daily” rate basis. In addition, counsel should be aware that Mr. Ashley is free to accept other engagements following the scheduled end of a mediation when he has been retained on an hourly basis.
- The attorneys are also charged an administrative fee of $150 per party (or separately represented group of parties) to cover the costs of setting up the file and administering the case.
- Fees are the responsibility of the participating attorneys and are split between them in the manner they designate.
The attorneys are required to advance the full amount due under the rate option selected within 10 days of the scheduling of the mediation, or sooner if the mediation is scheduled on short notice. Continuation of the mediation will not alter this requirement. Counsel will be invoiced for unpaid work upon the completion of services.
No Other Charges
- No charge for travel within Southern California.
- No charge for use of neutral facilities in San Diego, downtown Los Angeles, Century City, Orange County, San Francisco, the Inland Empire, and Las Vegas, Nevada.
Mediation Time Scheduling
Mediations reserved on an hourly basis are typically scheduled to commence either at 9:00 a.m. or 1:00 p.m. on the day of the mediation. As noted above, where Mr. Ashley’s services are retained on an hourly basis, he may accept other engagements following the scheduled conclusion of the mediation. To assure Mr. Ashley’s availability throughout the day, his services should be retained on a “daily” rate basis.
Mediation Retainer Policy
Dates tentatively reserved are not deemed confirmed prior to receipt of payment in full for services. Tentative reservations shall be lost if payment in full is not received within 10 days of the date Mr. Ashley’s services are reserved.
Cancellation – Continuance Policy
- There is no charge (beyond the administrative fee) for a cancellation or continuance of a mediation that occurs 15 or more days in advance of the scheduled date of the mediation.
- The attorneys will be charged the full amount of Mr. Ashley’s fee in the event they cancel or continue the mediation within 14 days of its scheduled date unless he is able to book another matter at the same rate option for that date.
The foregoing information does not apply to mediations Mr. Ashley conducts as a member
of a court mediation/settlement officer panel.
